1. Acceptance of Terms

By accessing and using AOI Web Pro ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

AOI Web Pro is a professional aerodrome safeguarding software providing:

• ICAO Annex 14 OLS (Obstacle Limitation Surface) evaluation
• ICAO Annex 14 ICAO OFS (Obstacle Free Surface) evaluation
• ICAO Annex 14 ICAO OES (Obstacle Evaluation Surface) evaluation
• ICAO PANS-OPSV isual Segment Surface (VSS) analysis
• ICAO EUR DOC 015 Building Restricted Areas (BRA) analysis
• Custom surface evaluation tools
• Airport, runway, and navaid data management

3. Account Registration

To use the Service, you must:

• Provide accurate, current, and complete information during registration
• Verify your email address before accessing the platform
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3.1 Account Sharing Prohibition

Your AOI Web Pro account is for your individual use only. You agree NOT to share your account credentials with any other person or entity.

When you subscribe to AOI Web Pro, your license is personal and non-transferable. Each user must have their own separate account and active subscription. Account sharing violates these Terms of Service and may result in immediate account suspension or termination without refund.

4. Subscription Plans and Billing

4.1 Subscription Tiers

• Trial (14-day free trial): Full access to all features for evaluation purposes
• Basic: Access to OLS, VSS, and airport data
• Pro: Full access to all applications and features

4.2 Payment Terms

• Subscriptions are billed monthly or annually in advance via Stripe
• Payment is due at the beginning of each billing cycle
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension
• Prices are subject to change with 30 days notice

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of your current billing cycle
• You will continue to have access to all features until the billing period ends
• Your subscription will be fully cancelled after the current billing cycle completes
• No refunds are provided for partial months of service or unused portions of your subscription
• Trial subscriptions will automatically cancell without charge after the trial period ends
• You may export your data before cancellation

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any aviation regulations or safety standards
• Upload false, misleading, or inaccurate data
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or sublicense the Service without permission
• Use automated systems to access the Service (bots, scrapers, etc.)
• Interfere with or disrupt the Service or servers

6. Data and Content

6.1 Your Data

You retain ownership of all data you upload to the Service. You grant us a license to use, store, and process your data solely to provide the Service to you.

6.2 Data Accuracy and User Responsibility

You are solely responsible for the accuracy, completeness, and validity of all data you input into the Service.

We provide computational tools and analysis capabilities, but we do not verify, validate, or certify the accuracy of user-submitted data or analysis results. You acknowledge and agree that:

• You are responsible for verifying all input data before use in the Service
• You are responsible for validating all outputs and results from the Service
• If your regulator, Civil Aviation Authority, or State requires software validation or certification, you are solely responsible for conducting such validation procedures
• You must independently verify that the Service meets your specific operational, regulatory, and safety requirements before relying on its outputs
• The Service is provided as a computational tool only and does not constitute regulatory approval or certification

6.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backups of critical data.

7. Professional Responsibility

IMPORTANT: This Service is a tool to assist aviation professionals. It does NOT replace professional judgment, certification, or regulatory compliance requirements.

• All analysis results must be verified by qualified aviation professionals
• Users must comply with applicable ICAO, EASA, FAA, and local aviation regulations
• The Service does not constitute professional aviation consulting or certification
• Final decisions and certifications remain the responsibility of qualified professionals

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Like any software application, AOI Web Pro may contain bugs, errors, or defects. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The Service will be free from bugs, defects, or programming errors
• Results from the Service will be accurate, complete, or reliable
• Any defects or bugs will be corrected within a specific timeframe
• The Service meets your specific requirements or operational needs

You acknowledge that software bugs and errors are inherent risks in any software application, and you accept this risk when using the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AOI WEB PRO, ITS DEVELOPERS, OWNERS, AND AFFILIATES SHALL NOT BE HELD LIABLE OR RESPONSIBLE FOR:

• Any errors, inaccuracies, or defects in the Service or its outputs
• Any damages, losses, or harm resulting from the use or inability to use the Service
• Aviation incidents, accidents, near-misses, or safety occurrences of any kind
• Regulatory non-compliance, violations, enforcement actions, or complaints
• Property damage, bodily injury, or loss of life
• Decisions, actions, or omissions made based on Service outputs
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or reputation
• Claims by third parties including regulators, authorities, or affected parties

OPERATIONAL USE VALIDATION REQUIREMENT:

You acknowledge and agree that you MUST validate the Service before putting it into operational use. The Service is provided as a computational tool that requires independent verification and validation by qualified professionals before use in any operational, regulatory, or safety-critical context. Your use of the Service for operational purposes without proper validation is at your own risk.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Bug Reporting and Software Issues

While we strive to provide a reliable and accurate service, like any software application, AOI Web Pro may contain bugs, errors, or unexpected behaviors. We appreciate your assistance in identifying and reporting these issues.

All software, algorithms, designs, trademarks, and content (excluding your data) are owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works without written permission.

12. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Termination

We reserve the right to suspend or terminate your account:

• For violation of these Terms of Service
• For non-payment of fees
• For any legitimate business reason (such as service discontinuation, business restructuring, or compliance requirements) with 30 days written notice

Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

You agree that the courts of New Zealand shall have exclusive jurisdiction over any disputes, claims, complaints, or legal proceedings arising out of or relating to these Terms of Service or your use of AOI Web Pro.

By using this Service, you consent to the jurisdiction and venue of the New Zealand courts and waive any objection to such jurisdiction or venue.
